The short version, and the long one.
These terms are a contract between you and The Drop ("we", "us"). By creating an account or using the app you agree to them and to the Official Rules, which are part of these terms.
1. Who can use The Drop
You must be 18 or older and a resident of the United States. One account per person and one account per device. You are responsible for everything that happens under your account and for keeping your sign-in method secure. Tell us right away at hello@thedrop.today if you think your account has been accessed without permission.
2. The game
Play is governed by the Official Rules. Drop Coins and Spin Coins are promotional units used inside the game. They are not money, are not your property, have no cash value except as described in the Official Rules, cannot be purchased, sold, traded, or transferred, and may be adjusted or voided under the Official Rules, including where fraud or error is involved.
3. Drop Plus
If we offer Drop Plus, it is an auto-renewing subscription billed through your Apple ID at the price shown before you buy. It renews automatically until you cancel in your Apple ID settings at least 24 hours before the end of the current period. Drop Plus unlocks content and features only; it has no effect on the prize game. Refunds are handled by Apple under its policies.
4. Your conduct
You agree not to: copy, record, or redistribute video from The Drop; share answers or outcomes before a Drop Point is revealed; use bots, scripts, or emulators; create or use more than one account; collude to manipulate a pool; reverse engineer the app; or interfere with the service or other players. We may suspend or close accounts that do, and void associated coins.
5. Our content
Videos, questions, artwork, and the app itself are owned by us or licensed to us from the creators who made them. We grant you a personal, non-transferable, revocable license to use the app as intended. All other rights are reserved. Creators retain ownership of their footage.
5a. Clips you share
Hosts can make clips in Studio and choose to share them with other hosts. If you share a clip, you confirm that you filmed it or have permission from whoever did, and that everyone who appears in it agreed to be in it. You give The Drop and every other host a worldwide, royalty-free licence to store, play, and show the clip inside The Drop's games for as long as it stays shared. You can unshare a clip at any time; games already built with it keep their copy. We don't review shared clips before they go live. Anyone can report a shared clip and it comes down at once; we follow the notice-and-takedown process at thedrop.today/takedown, and hosts who repeatedly share clips they don't have the rights to lose the ability to share.
6. Changes and termination
We may change the app, the Official Rules, and these terms. Material changes are announced in the app before they take effect; continued use after that means you accept them. You may stop using the app at any time and may delete your account as described in the Privacy Policy. We may suspend or end the service, or your access, for breach of these terms or for any reason with 30 days' notice, during which Spin Coins remain redeemable under the Official Rules.
7. Disclaimers and limits
The Drop is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits. Our total liability to you for any claim is limited to the greater of $100 or the value of your unredeemed Spin Coins at the time of the claim. Some states do not allow these limits, so they may not apply to you.
8. Disputes
These terms are governed by the laws of the State of Oregon. Before filing a claim, you agree to contact us at hello@thedrop.today and give us 30 days to resolve it informally. Any dispute that is not resolved will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. You and we each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration clause by emailing us within 30 days of first accepting these terms.
9. Apple
These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it. Apple is a third-party beneficiary of these terms and may enforce them against you.
